"It Is Our Patent, Get Off It" : Kodak Sued Apple


Bangalore: All thanks to Kodak for working with Apple in the 1990’s, as their much debated and argued patent problem still continues. Kodak sued Apple as it claimed that some of the patents are being derailed by Apple in order to stop it from surviving.

The former photo giant filed for bankruptcy protection in January 2012 and is now suing Apple for infringing its patents. Kodak also provides figures to prove that it had earned $3 billion revenue  from these patents. But Apple strongly came back stating that it owned 10 of the patents from the portfolio of digital imaging and the patent exchange happened when Apple and Kodak worked together during their good old days in the early 1990's.

Kodak claims to have made $3 billion by licensing these patents to over 37 firms. In order to save it from shattering, Kodak plans to sell these patents but Apple interfered the sale and filed a lawsuit. Kodak argued saying that “Apple uses its substantial cash position to delay as long as possible the payment of royalties to Kodak, and to interfere with [Kodak's] planned ... sale of patents”

Kodak and Apple have been at odds since the early 2010, when Eastman Kodak sued Apple and RIM for infringing upon its image-previewing patent via the camera apps as seen in most of their smart phones today.In January 2011, the chief judge for the International Trade Commission (ITC) ruled that neither Apple nor RIM infringed Kodak's 2001 patent. Kodak challenged the finding and a full six-member commission was set to inspect, said it would review the ruling. Last month, the ITC had found that the image-previewing patent is invalid.
