Yahoo sues Indian firm for using its trade mark

NEW DELHI: Yahoo Inc has sued an Indian company in the Delhi High Court for illegally using its brand name for manufacturing and selling wafers and confectionery products in the country, according to a news agency. Justice Manmohan Sarin issued notice to Hyderabad-based Dyna's Wafers and Confectionery (DWC) on a petition by the US Internet company seeking to restrain the proprietors and their agents from dealing in wafers or any other products under the trade mark "YAHOO". The news agency reported that Yahoo's counsel Pravin Anand alleged that DWC adopted the brand name Yahoo for their products to cash on the global reputation of the American company to pass off its goods as that of foreign company. Yahoo Inc submitted that the trade mark "YAHOO" was not restricted to computer and internet related services, but extends to books, magazines and collateral goods including clothing and computer accessories. The counsel was quoted as saying by the news agency that Yahoo Inc has licensed the "YAHOO" mark for use in connection with candies, chocolates, mints, ice cream etc pursuant to co-branding agreements with reputed multinational firms.
