CCPA and ASCI Join Forces Against Misleading Digital Ads
In a bid to safeguard consumer interests and combat misleading advertisements in the digital era, the Department of Consumer Affairs (DoCA) and the Advertising Standards Council of India (ASCI) have joined forces. This collaborative effort aims to ensure compliance with advertising standards while upholding the Consumer Protection Act of 2019.
The synergy between ASCI's code and guidelines in advertising and those enforced by the Central Consumer Protection Authority (CCPA) has been acknowledged. The CCPA has acknowledged the potential violation of consumer rights resulting from misleading advertisements and their alignment with ASCI's regulations.
Recognizing the gravity of the issue, the CCPA has urged ASCI to forward any non-compliant advertisements, which could potentially breach the ASCI Code and the Consumer Protection Act of 2019, along with relevant guidelines, for appropriate action.
Cases escalated by ASCI regarding misleading advertisements will be promptly addressed by the CCPA in strict accordance with the Consumer Protection Act of 2019, as affirmed in their statement.
Manisha Kapoor, CEO and Secretary-General of ASCI, expressed gratitude for the collaborative approach, emphasizing ASCI's expertise in advertising regulation. She highlighted the importance of a robust self-regulatory system and deemed this partnership as a significant stride towards advancing self-regulation.
Amid the evolving landscape of advertising, particularly in the digital realm, this collaboration assumes paramount importance. Rohit Kumar Singh, Secretary of DoCA, underscored the complementary nature of CCPA and ASCI's objectives in effectively addressing infringements. He stressed the need for a collaborative approach to tackle the new challenges posed by digital advertising.
