Ishar Law: Understand and Access Immigration Law with Ease

Iqbal Singh Ishar, Managing Attorney

Millions of people from around the world seek asylum in the United States of America by declaring that they have a well-founded fear of persecution in their home country on account of either race, religion, nationality, political opinion, or membership in a particular social group. One such person of the Sikh faith was seeking asylum after he fled from Afghanistan upon facing religious discrimination by the Taliban. His petition was taken up by the Legal Aid Clinic of a law school, which subsequently lost the case before the immigration court and the BIA. By custom, people of the Sikh faith wear a turban and retain a beard, but the petitioner had a clean shave and chose not to wear a turban. In the previous hearings of the case, BIA and the court decided, based on his appearance, that the petitioner was not practicing his religion; hence the complaint on religious discrimination was not valid.
With knowledge of the religion and the immigration laws of the country, Mr. Iqbal Singh Ishar, the managing attorney of Ishar Law, filed an appeal before the United States Court of Appeals for the Second Circuit. "It doesn't matter what he does with his religion, what matters is that the Taliban sees him as a person of another faith. And, if it's not the religion followed by them, not the same lifestyle practiced, they discriminate," argued Mr. Ishar in court. Having taught and worked with students from 50 countries while holding the position as executive director of the Global Law School Program at NYU Law School gave him the knowledge of various other countries' legal and social systems to win the case.
A litigator by experience, Mr. Ishar has been a member of the New York State Bar since 1991 and is also admitted to practice before 'the United States District Court for Southern District of New York and Eastern District of New York' and 'the United States Court of Appeals for the Second Circuit.'

I have an academic perspective to what I do. I'm not a very hardcore businessman, especially not the kind who's always looking for the bill. If a person needs help, I'm always thinking, how can I be of help to them?

His approach and commitment to work with clients are highlighted by an instance where a client in legal turmoil was advised by Mr. Ishar that their situation could be solved only if immigration laws in the country were reformed. When the client asked about the consultation fees, he replied, "I don't charge people for telling them; I cannot help you." One corporate client who had worked with other law firms prior to retaining the services of Ishar Law was surprised to know that they can send the check for legal fee along with the signed applications/petitions prepared by Ishar Law. "He (the client) said that he was used to working with lawyers who did not start working on their cases until they were paid. I said that that is not how we work with our clients, we trust them," recalls Mr. Ishar. The firm's staff also follow a similar approach to professional responsibility and ethical sense.
