Clearwire sued by Sony Ericsson over Swirl logo

Virginia: A lawsuit has been filed against the Kirkland based Clearwire by Sony Ericsson, accusing the former of federal trademark violation on the green and white logo used for its CLEAR wireless services.
According to the court filing presented in the Virginia district court, Clearwire's "sphere with swirl marks' is "confusingly similar" to that of Sony Ericsson's collection of logos and it has also mentioned that "the logo is an attempt to gain an "unfair competitive advantage" in the smartphone and mobile broadband market."
Even though, Clearwire agreed to stop using the swirl logo after a dispute earlier, still it has not stopped using the logo in advertising which has led to the lawsuit file.
Though, both companies vie in dissimilar fields of the technology market, Sony Ericsson complains that Clearwire has plans to enter the production of smartphones as a direct competition that has been announced a few months before.
The filing read as follows "While Sony Ericsson welcomes competition on the merits from Clearwire, Clearwire's use of logos that are strikingly and confusingly similar to Sony Ericsson's recognized, federally registered logos is illegal and should be enjoined."
