AT&T, Verizon dismiss suits over ads

Dallas: AT&T and Verizon Wireless have agreed to dismiss competing lawsuits against each other over ads comparing their respective 'third generation' wireless networks.
In court papers filed in federal district courts in Atlanta and New York, neither side gave any indication about why the suits were being dismissed. In separate interviews, representatives for Dallas-based AT&T and New Jersey's Verizon Wireless declined to elaborate on why the two suits were dismissed. But Audrey Lundy, a Verizon Wireless Spokeswoman, confirmed in an interview that the company's marketing and advertising plan hasn't changed because of the end of the litigation, reports Dallas Business Journal.
Verizon Wireless' suit, filed in July, sought a court judgment declaring that it was both truthful and in compliance with the law in advertising its so-called '3G' network as 'America's most reliable.' According to court records, AT&T took issue with that claim, asserting that speed is an essential component of the reliability of a network that uses 3G technology.
In the second lawsuit, AT&T contended that Verizon Wireless was running misleading print and television ads. Those spots had maps comparing 3G coverage nationwide between the two firms. AT&T asserted in court papers that the ads falsely implied that AT&T customers can't communicate on wireless devices when they are outside of 3G coverage areas.
Last month, an Atlanta judge turned down AT&T's request for a temporary restraining order that would have blocked Verizon Wireless from running ads featuring those maps.
