Violence At Maruti's Manesar Plant: Plan To Disrupt Peace

TU leaders’s Interventions

Though, hundreds of workers have got arrested, it is doubtful if the union leaders, the actual mastermind behind the whole scene, will ever be brought to book; because most of them enjoy political patronage. But it will not save the workers from liability to compensate for the damage that they caused to the company.

The Supreme Court ruling said, "Where person, whether jointly or otherwise , are part of a protest which turns violent, results in damage to private or public property, the persons who have caused the damage, or were part of the protest or who have organized will be deemed to be liable for the damage so caused, which may be assessed by the courts or by any special procedure created to enforce the right."But, so far, it has been a lengthy process in India to identify the culprits, fasten liability and enforce the compensation decree, which will tire out both the management and workers.

It can be noted that, over the years, the governments in power have done little to ensure healthy industrial relations and parties have ever extend their sway into trade unions. In the country, the TU leaders continue to enjoy a lot of acceptance and among the workers they have all the authority to mobilize them into activities. It is high time the government and the various political parties had discussed the need for a law terming leaders of all TUs as public servants like MPs and MLAs. The MPs and MLAs were described “legally and morally” as public servants by the five-judge bench of the SC unanimously ruled in the JMM MPs bribery case.
