Oracle Lost Second Time in the Court this Year


 

The case is not closed yet, as HP and Oracle now prepare for a second trial from August 22 to determine whether HP will also be able to sue for damages. HP filed the suit seeking up to $4 billion in damages, which it claimed would be the loss of server sales till 2020 without Oracle’s support for the Itanium processor. Now after the court decision, HP may sue for about $500 million in damages, blaming Oracle for slowing down sales of its high-end server business.

The fight started when Oracle bought Sun Microsystems and entered into the server hardware field, in which it previously partnered HP. The fire ignited when Oracle hired ex-HP CEO Mark Hurd. He was faced with questions over his relationship with a female contractor. HP sued Oracle but then they settled. As part of that settlement, Oracle promised that it would continue to offer its product suite on HP platforms according to the partnership agreement which existed prior to Oracle’s hiring of Hurd.

Oracle is not having a good year with lawsuits. Earlier this year, it lost another major legal battle against Google over infringement of Java code in the Android OS.
