Three main real estate laws in Turkey

Turkish legislation is considered to be quite loyal and easy to understand. It is important to remember that the Turks easily issue long-term visas and residence permits to foreigners. Law No. 1: Transactions with apartments are carried out only through an official real estate agent

This resolution came into effect relatively recently: until August 31, 2020, a license was not required to conduct real estate sales and rentals. Nowadays, the work can be carried out exclusively by licensed agents who receive a permit to operate for 5 years. Besides, since 2020, a mass testing of real estate agents for knowledge of legislation and language has been taking place. Other skills that indicate the competence of a professional are also being tested.

It is now unrealistic to find properties from the owner so much that when you call all existing development projects, you will really get to the agent in 100% of cases. The thing is that violation of this law entails the imposition of a large fine by a person who will be engaged in the sale or rent of property without having a license for that.

Law No. 2. Only legal entities can engage in short-term rentals

In 2017, a law came into force, according to which only companies or private entrepreneurs registered to conduct this type of activity can rent a property for daily rent or for a short period of time. This applies to renting housing for several months. Individuals can rent an apartment for a period of 1 year or more.

If the owner wants to engage in rental business and rent daily real estate for vacationers, then he needs to conclude an agreement for conducting this activity with a management company or a real estate agency.

The violation of this law also entails the imposition of a fine, and both the owner and the tourist living illegally will be fined, since in Turkey all temporarily residing travelers must necessarily be registered by a hotel or an apartment hotel.

Law No. 3. The owner cannot evict the renter from the apartment until the completion of an agreement. If the agreement is not terminated after a year of rent, then it is automatically extended for another year.

Turkish law does not allow to evict a person even if he does not pay for accommodation. You can go to court and demand payment from him in court, but it is impossible to evict him. Strict rules are often found in Turkey when taking up residence in from the owners:

  • Guarantor, who is a citizen of Turkey;
  • Payment for a year in advance;
  • IOUS.

Before taking up residence, the renter gives IOUS to the owner for each month of residence. After receiving payment for each new month, the owner returns one sennet (receipt) to the renter. So, the owner is additionally insured against non-payment. The promissory note will become a weighty basis for filing an application to the court.
