Social Media Witness Rage As SC Forbids Gay Sex

New Delhi: A foremost whammy to gay rights in the world’s biggest social equality, the Supreme Court on Wednesday detained that homosexuality or unnatural sex between two agreeable adults under Section 377 Indian Penal Code (IPC) is unlawful and it will go on as a serious offence.

 “The decision to change the law is vested in Government of India, thinking Delhi High Court had violated its powers with the decision taken four years ago,” the Apex Court said.

The bench comprising of G.S. Singhvi and S.J. Mukhopadaya put aside the High Court’s verdict legalizing homosexuality. Section 377 vehemently states that whoever willingly engaging in sexual intercourse regardless of the character with any person or animal does an aberrant crime.

The Bench said: “We hold that Section 377 does not suffer from… unconstitutionality and the declaration made by the Division Bench of the High Court is legally unsustainable.” “Notwithstanding this verdict, the competent legislature shall be free to consider the desirability and propriety of deleting Section 377 from the statute book or amend it as per the suggestion made by Attorney-General G.E. Vahanvati,” it added.
