Is Hari Prasad an ethical hacker and be set free?

Hyderabad: When V Hari Prasad, the man behind the Electronic Voting Machine (EVM) tampering fiasco, said he deliberately displayed the EVM number on the TV in order to show that the original machine was tampered with, was he at the right or wrong side of ethics? Should he be allowed to go scot free?
Well he is not done yet. Prasad announced in a press conference that he would continue to fight his battle against the EVMs, which the Election Commission of India asserts are tamper-proof. Prasad added that he had done no wrong and had just highlighted the flaws in the EVMs.
This came after he was arrested for the alleged theft of an EVM. He was kept in the police custody for eight days. While he denied stealing the EVM, he said, "someone came to me and asked me to show how an EVM could be tampered with." He claims that he returned the machine within 3-4 hours after displaying how the device can be tampered with and added that this was filmed and telecast on a private news channel.
Prasad went on to request the techies of the nation to raise their voices and expose the EVM flaws.
Reacting to his arrest, he said, "I am unfazed and instead I am more inspired to continue the battle against the vulnerablilty of EVMs and will be in continuous touch with the Election Commission of India (ECI)."
While the mud slacking is expected to continue from the both sides, the question here is whether Prasad's action be taken under law, or will he be given the tag of an ethical hacker and set free?

the flaw instead of being prosecuted. I was
wondering how come the congress won with such
a majority ( whatever little it got) in the
last general election. More than any one
else, the opposition should rise to protect
Hari Prasad & he should be public given a

hackers have been falsely accused and were
put behind bars because of the information
they posses.... I think all ethical hackers
should try to form a union against this act

in public.. and govt arrests the person for
showing the technical fault of govt. EVM...
its very pathetic and it means only banning
the use of technology in the country and
arresting security researchers like this
showing the power and on false charges... its

I just realized that how far ,,people would go to sully or post comments on with a hidden agenda,,like for example
some one below posted comments ""Evms kill tamils"" ,,i was a bit shocked ,,also there are personal attacks ,,like someone commenting on me about Congress agent or Foreign agent.
This shows it is getting murky here,,and shows how people are misusing the website.I suggest silicon india to moderate the comments ,,just like other media do,,like Economic Times Of India.
I want to say loud and clear,,I love India,,it is the country that I was born,,Iam not affilliated to any political party in particular ,,I make comments on merit,,I have also commented on CWG games,,too.
I have full respect towards Indias government,,becuase it is elected by people of India,,be it BJP,,CONGRESS,,Left all are the same.I want India to develop,,be strong,,her armed forces looked after ,,respected,,her institutions respecetd,,her dignity upheld and held high.
I repeat India is a great country,,it has a billion plus people,,with far more important and critical things.I have given examples to make an impact on India ,,positively. A recent survey indicates ,,Indians ranked themselves a Happy lot when a survey was conducted.

EVM and run Packman on that , only in this
case this is "EVM" , thats why it makes news

employees and teachers who work in its
polling booths day and night during
elections,,it can be your mother,,sister,,or
brother.Also EVM machine is designed and
manufactured by E.C.I.L with techical people
like Hari Prasad.Just because hariparasad
feels it has faults cannot jusitify going
live on a TV with two american colleagues no
way .India is much bigger,,no one can make a
duplicate indian currency or constitution not

If there is a fault with any of the govt agency/its working/its gadgets, please suggest any other effective method to bring it to the attention of the govt as well as public.
Note that if without the public knowing it, anything that is brought to the notice of the govt will be burried deep down, probably along with the person's body who exposed it!
So I think Mr.Hariprasad has done the right thing only and he needs the support of all Indians, not just techies as requested by him.
Unfortunately, our attitude will be, as long as it does not affect a person, he does not fully analyse the situation.

I want to give an example Sam Pitroda came all the way from USA to get an appointment with Sri Late Indira Gandhi ,,he could get only five minutes after three months ,,but he insisted that he has a plan for Indian telecom sector,,and he wants atleast 30 minutes or no appointment at all .Then seeing his strong will ,,her PA gave 30 minutes ,,the meeting in which both sri Rajiv and sri Indira attended and rest is history.You can check these facts with Sam Pitroda or from any source ,,and that was in two decades or more ago.Union Govt of India realizes the issues and Iam sure ,,if intention is good ,,he could have met ,,someone from ruling party or opposition in New Delhi.Iam sure it will be the same case if I wanted to meet politicians in Australia,,uk,,usA

If you know anything about the USA, a similar thing happened about 3 years ago when a Professor exposed the vulnerability of the EVM they were proposing to use in the State of Maryland. I think you have a very static idea about India and Indian Politics. It is changing every day with situtation going from bad to worse. Every political party have a few people good on paper and this list is getting smaller day-by-day with each politician getting implicated in one or other scandel.
Taking the approch as suggested by you has got a very rare chance of seeing the light of day. The endless problem of highlighting the wrong-doing of government work and machineries can be seen by the plight of murders taking place of the wishle-blowers (who took the fight using the RTI route) around the country.
I am not justifying that Hari prasad has done right by showing the Demo of the vulnerability of the machine in details, but I support him in his effort to expose the machine through media. Because if he had taken any other route this news may not have been news. The case would be shut down and the people would not know if their vote really counts or not in electing a particular candidate of their choice. Atleast this exposure should make technocrats or EC to come up with some mechanism to have a fair election or shut the gaps in the machine to make it full proof.
Now about law and legality, I know you know a lot about law and history of the country politics. So you will also know about the various sting operations that take place everyday in exposing various political leaders and office bearers and also the after effect of all those operations. So here there is two law - one for powerful and at most time corrupt and others who cannot afford the law. For Hari prasad, if he is smart enough - can come out of the clutches of law and either fight a battle with a vast majority of population supporting him or be a puppet of the ruling mass a forget ever, that the he had ever found any problem in the EVM machine at first place. The future depends on how we react to the news and take things forward. Just burying the news as a mere stunt, we should have the EVM machines again recheched and verified by qualified experts from with-in and outside the country and get the, problem if any solved, so that the common mass have their faith back on Democracy.
