Innocent techie in jail, sues Airtel for
20 Crores

20 crores. Airtel had given wrong information to the police which forced the techie to go to jail. "I have spent 50 horrible days in jail. You can't measure the trauma which I went through, my family went through," says Lakshman Kailash, a 28 year old engineer to CNN-IBN.Kailash was a successful software engineer with HCL and was working in Bangalore. Two years ago, Pune Police team in Bangalore had arrested him for 'defaming Shivaji' in a picture he was supposed to have put up on Orkut. Police was fed with wrong IP address by Airtel, who searched for the IP for two days. The police traced the IP, which belonged to Kailash and arrested him and did not let him go even after the police claimed to have caught the real culprits about two weeks after his arrest.
Maharashtra Human Rights Commission asked Airtel to cough up
2 lakh as compensation, but Airtel did not do so. Now, its top executives have been summoned by a magistrate court in Bangalore. "Its a small amount for them and I really don't understand why they are not paying up. They have to follow court orders. They are citizens of India, whether they think they are guilty or not is secondary," says Kailash.Since Airtel has not paid any kind of compensation so far, Kailash has moved to National Consumer Disputes Forum and now seeks a compensation of
20 crores. "You can't scale those horrible moments in money. I feel it's a less amount with respect to the trauma I went through because I have to carry it throughout my life," says Kailash.

How possibly can Airtel have made such a silly and idiotic mistake over such an important issue? Do they understand the implications when they are asked to share such kind of information? Airtel should definitely be held and compensate for their mistake. Kailash, you are right in asking for the compensation and this case should be made a precedent for the corporate world and any individual to act responsibly in what they do.

For the last few years most of the Indian Companies R operating their business & service throu' their appointed franchisees (or) shall V call it as associates of the company.
This culture of operations is nothing but a foreign culture by the companies is being spread like a virus in our Indian contry who want 2 escape from the mistake at the crucial juncture by washing out their hands in case of Legal arises is alarming phenomenon.
Rendering of functioning or customer service is so bad at all times without any care for the people. I would compare the same with Banking sectors (for eg., Credit cards payments Recovery & other issues related to the Institutions).
The same way Airtel is also functioning to the height of patience towards the customers. The Higher authorities should be punished as well the compensation should B given maximum to the sufferer techy guy.
It's a lesson for other companies.

Mere monetary compensation alone is not the solution, these careless culprits should also undergo the same jail sentence as Kailash suffered. These big guys have all the crooked ways to avoid paying the compensation and to the maximum extent (if our Honorable Court gives verdict in favor of Kailash), they pay and escape. This in no lesson to them or the other birds, only if the heat of trauma is felt, only then these kinds of atrocities can be checked.
Appreciate your courage Kailash. Keep it up. We are with you.

It is amatter of great pain for me as an Indian and human being I can understand the harrassment you and your family has undergone. Kash ke tum India mein nahi hote , US ya Canada mein hoteAirtel ko Chhatti ka doodh yaad aa jaata. I am in Toronto now a days and was reading a news few days back in Toronto Star. A citizen of Canada by mistake was withheld in some other country because of her lips were looking different in her photograph of her passport she was charged for fake passport and detained for 90 days ultimately she came out to be right and came to Canada she was not only given a celebrity treatment but now she has sued the Canadian Government for 20 million dollar. Getting full suppoert of media too. Just for your information she is Black and Muslim but in Canada once a person is citizen of this country all other things has no criteria of discrimination. Kya hamare desh mein aisa hona possible hai.

This is appropriate to charge this much of amount. Until and unless there is sufficient amount of fear or loss, these corporates would not care for humanity. The loop holes in law enables such mean and selfish corporates escape easily and repeat their immoralities. In western countries, consumers or public cannot be fooled because if peolple sues a company then the company must pay compensation. Here we are taken for granted.

Kailash, This is the right step from you. We all Indians are with you. In the 100Cr population, you will get log of diff ideas and depends on the ethics followed by them. But the real hero is the one who keep the dare to fight against the Injustice. To sit silent is also the crime. We should always welcome the person like "Kailash" and must show our unity. One more thing, please don't call HIZRA to the person like "HUSNI". HIZRA's are far better and they don't sit silent, they faught for their rights in this cruel society. "TV serial SACH KA SAMNA" me sayad dekha hoga.

Wise step taken by the victim of the case. It will take time and have to fight upto Supreme Court of India. Big Company like Air-tel would not comply the direction/order of the National Comsumer Court and prefer an appeal before the said court. As such be ready for long legal-battle in the case. I am not that this all leading in right ways but summerising my points here.
First of all, sure Airtel needs to pay the amount told by Judiciary as Maharastra Police responded on an Official Information lead from Airtel. Its purely legal and even if its due to some of their employees mistake or a poor process setup misleading to such wrong info. Nothing could be compared with the situation that someone was behind the bars coz of no reasons.
On the other side, I could understand the limitations with Police guys and Airtel persons, but I am surprised that on what basis police can arrest a man? just on basis of some IP? Posting a picture to orkut? There must be some orkut account and information collected must not be only IP, but some computer ID as well or something else, which might have the pieces more concrete.
Somewhere it looks creepy that one person is suing a company for 200 million, just coz its a big company, why not this opposition to Police as well? Why not Kailash standing against the same as well.why not comments coming in that ways as well? Why Airtel? They are same Software/ Hardware Engineers like Kailash and I am sure that he could relate himself with them that a system could make such a mistake in providing information, but still. its like.
What happened to Kailash, is wrong, but the responsible is not only Airtel, but Police is more

Sanjiv I completely agree with .. I hope if u get arrested for defaming some one or posting porn pictures as a racket etc which u havn\'t posted or have no connection with ....but suddenly one fine day u are in jail becoz of it .. and stay in jail fr a few months before the ISP supplies the correct \"static/dynamic/whateva IP\" den that should be just fine with you .. because ofcourse .. the error was inevitable .. nd the ISP did nothing wrong by pointing a finger at you.. i m sure this argument would come in handy .. nd obviously a few months of break from ur company cudn\'t hurt dat much .. i mean nuthing beats relaxing in jail right? .. nd look at the bright side of the whole thing .. once u are back .. u wud have earned a reputation that people would swear by .. but then the poor old ISP .. dey are certainly not at fault .. i agree vehemently man ..
BTW .. lemme remind you dat Kailash is seeking 20 Crore after the company simply refused to cough up a meager 20 Lac
which simply put is like saying "So what if becoz of us u had to stay in jail ... big deal ..."

200 Million for Wrong IP in India cumon dude...have a life...
I have couple of questions?
1) Was "Kailash" using AIRTEL Services from "HOME"?
or
2) The IP Address which was thought to be of "Kailash" was of his Office Computer?
Because AFAIK AIRTEL uses static IP and unless "Kailash" change the static IP himself for some experiment it cannot be changed. Period.
If the computer was using DHCP then it has to be his office connection. To me it will sound really strange if an IT company has no fixed IP class "A" for there network but it was office computer then it will be bit difficult to identify the real culprit . But when you log in to office network your private IP will be used not your public IP so in this case you really have to know first what kind of details were provided. Provide me a public IP and i can let you know the excat location where this IP resides currently. But the location can change with time as IP are always leased and if it gets refresh / renew then a new IP is assigned which can be totally diffrent so in this case someone else can get your old IP as his current IP and in this case it appears A used an IP to upload an image and then the lease got over of A's IP and his IP was assigned as new IP to "Kailash" so in this case what should have been done was first check the date and time when image was uploaded (You may want to involve orkut for this) and then match the address of IP user on that day and time. Folloing this small step you cannot go wrong in identify the cuprit at first instance.
But if Kailash was using HOME computer and was using Static IP without changing the workgroup which works with service provider and if there was no change in tcp / ip or netbios then service provider is responsible. period.
I may be wrong but this is what i think :)

Airtel and Airtel group is the worst company in India. They Never fullfill their commitment to customers. I have a example, when I used XYZ telecome services, my mobile bill was an average Rs.600. Now as Airtel subscriber I am paying more than Rs.1000, with better package and low usage.
I am requesting to my friends, please away from Airtel.

You are right. Airtel has lot of technical limitations. Its sad that an innocent person should suffer because of their limitation to provide with the correct information. The only way to teach these guys a lesson is to boycot their services by the IT community. I am also suffereing due to their inability to provide me with correct information. Takinig them to the TRAI tribunal and consumer court. Imm giving up my airtel digital TV and mobile connection.

I think the particular person at Airtel who gave wrong info to Police must be first arrested and put in jail without any trial for 6 months and the company must explain in the Hon'ble court of Law as to why they should not pay 20 Crores. Common man also has equal value as VIPs in this Country...
Thanks

How did I felt 2 years back:
---------------------------
Why did Kailash waited for two years? He should have applied for life time compensation earlier. I remember his statements in the first article in TOI. If he was in jail for 50 days, what his parents/relatives were doing, why didn't they do something about it. They would have approached media for help. I felt very angry on Kailash for not doing something immediately.
Present:
-------
Penalizing Airtel will not bring any change in typical "Indian customer service" attitude. This will be an isolated incident. Guys don't dream of India get organized like West. This can never happen.

The Indian Police is known as the single biggest corrupt entity in the whole world. Hi Kailash,
Any human being is not supposed to undergo such a harsh and traumatic experience just for the sake that the person has expressed something. Why do we term ourselves as a country wherein we have freedom of speech and expression when just expressing ourselves can land us in such trouble. Anyone who has any sense of humanity will empathise with you to the fullest. The human rights commission need to take a stock of the laws that the police continues to break in their quest to deter crime rates but at the same time turn a blind eye on the several crimes that happen in daily life like six-seaters plying illegally and hooliganism which is rampant in cities like pune and bangalore as they are educational hubs. Secondly its great that even a major service provider like Airtel has been taken to the court and are now being asked to cough up. This will serve as an example to all multi-national firms as well the service providers of any domain who use their mint power to harass innocent and loyal customers.

Airtel is not known for its customer sensitivity. Consumer activism will take time to play significant roles in product purchase which is the real sweet spot. Till such time, organisations can do what they want with the immunity we give - how many Kailashes are there? 5%? Estimate 15 years before any change is seen. Legal systems are also slower and compensation awards are lower than all developed countries.

Firstly, no money can compensate the ordeal of 50 days of Lakshman Kailash. But, it would definitely acts as deterrent to other service providers for their irresponsible behaviour, due to which an innocent has suffered. Secondly, this chikki bukki, whoever he is, needs to be taken to a ‘kink’ to assess whether he is a sane person. He has the temerity to call ‘sick people’ those who are supporting Kailash for being incarcerated in jail for no fault of his. If he is a spokesman of Airtel, he should reveal his real name & face the consequences. If he is not, he should shut his mouth, instead venting his anger publicly on Kailash’s supporters as its only damaging whatever reputation is left off his company. Thidly, the court is bound to take a suo moto action against Airtel for contempt of the court for defying their order. Fourthly, the police, who are notorious for being inefficient, corrupt & incompetent, should be dealt with severely. It is sad that even after knowing catching the real culprit Kailash kept in jail. Fifthly, those police officers who are responsible for this callous act should be summarily dismissed and appropriate legal action initiated against them for foisting a false case against Kailash. As citizens we demand this as an optimal action action against Airtel & the concerned police & its officers.

Why victimize poor kailash, if at all he had posted the pic, the right approach would have to call him, counsel him and make him understand. If you harass a person, the grudge increases naturally. Technically, I see absolutely no fault on the part of AirTel. It is the police who are severely at fault here. Agreed that AirTel should have informed the ploice that tracing an IP address does not prove with any conclusivity that the user was the culprit in any way.
Knowing the sensitivity of the case, I would suppose no organization would have failed to inform the police of this fact. Even though it is impossibile for the police to claim that they were not aware of this fact.
If the Police went ahead with the arrest and kept him in custody, I suggest we direct our emotiopnal outbursts with our minds and not just our hearts. The facts are straight. If the police was competant, they would have been diligent in their work and taken the IP with caution. Also, once the real culprits were caught, they should have acted instantly to repair the damage they had done.
The Police officials involved should be cauterized, stripped of their ranks and fired/imprisoned.

Why is it that to show protest to What Airtel has done everyone should boycott the use of any of their service. For any business, it is essential that they serve the customers with all the commitment they have for the business runs on the patronage of the customers. The only mistake Lakshman Kailash did was that he was paying for the thankless service extended by Airtel. Airtel has long history of charging for no service. I used to be an Airtel customer in Chennai years ago and had to pay my mobile bills when I was outside India and the sim card was also with me. Those were days when individuals could not afford even South India roaming or even National roaming. So my mobile was not used and I was still billed. A countrywide boycott will put all those corporates with no societal obligation in the right position. Lets all campaign for a nationwide boycott of Aitel Services.

if the government start terminating the police officers , because of there inefficiency, i think 99% of them will be terminated, because 99% of them are inefficient. But I request you not to worry. Another generation who is full of patriotism is ready to take their posts. Please make a difference. I understand that we have to change, but how much time will it take to slowly change, years, centuries !? we need change within an year, which is only possible by c change in the government employees who are corrupted and change in the politicians who are corrupted, the later is difficult while, the former is not that much. So please government go ahead and sue atleast one of the corrupted officers, and dismiss them from the job. According to me there should be some physical test once in an year atleast for all the police men, and some phsychartic counsessling for them to motivate them and to fill them with patriotism and to keep them fit. Other wise in 1 or 2 years they will be just as lazy as our police men are now.

It is ridiculous that the Police has kept you behind bars inspite of knowing the actual culprit. I would suggest that Mr Chidambaram should take this issue as a security breach and sack the concered police officials and then terminate the license for Airtel as they have not heeded to the courts appeal. If Airtel is not paying, it directly means that both the Government and Airtel are in sink and sinking the life of Mr Kailash.

Dear Kailash,
Really I feel very sad for what has happened to you as one of our co-citizen.
The time has really come for mother India to protect her child from all the MNC companies who are now a big threat for the middle class and lower middle class even higher some times.
They started their business to serve us, as days passed and they have earned more money from our hard worked pay now they want us to serve them. Not only AIRTEL there are many other MNC’s including banking sector, Aviation, Government and lot more. Where they treat their customers as Dogs, because they think who will ask them as they have grown as such a big firm as most of the govt officials are even afraid to go against them. They are adopting a behavior of dogmatism.
If this situation is not going to change today, it will never change ever. I hope god is using you as a tool to make India realize how their citizens are really treated in their home country.
Kindly don’t give up your mind against this case. We all Indian’s are with you? What if this has happened to me or my brother? Every Indian should take these very personnel.
It’s for sure if we leave this as such, today its Kailash and tomorrow it will be you, me, your father, mother, brother or any of our near and dear.
Anyone in this country not only in this country in the whole world should think 100 times before even pointing his hands against Indian. If even Indians are not going to treat their brothers with respect, courtesy and Kindness then who will.
Thanks & Regards,
S.Grace Paul Regan

Great work Kailash.
My experience with Airtel is no better. I had paid up the last bill and then closed the account. Even then the bill used to come with Monthly rental. Customer care said, it was OK and I should neglect the bill as it was worngly generated.
Two years down the line, me and my family started getting threatning calls from recovery agents that if I do not pay up they will send police and or other modes. I was perhaps not so courageous or to say did not want to get into such issues so I paid up another around 8 thousand as bill.
I am sure there are similar stories in the market about Airtel acts.
Wishing you all the best.

Airtel guys are third rate crooks...Their billing information is deliberately vague--just like bars have dimmed lighting to fudge their bills. I have had major billing issues -- the fact that there were issues is not very hurting -but the fact that there was nobody to speak to was horrible. Every time I called up an Airtel rep, he would direct me to some one else and the second call I made to that person would be cut. On top of all this I had paid close to 4000 Rs extra and was told not to pay my next bill. The cell connection was cut citing the fact that i had not paid my bill. All this happened when I was alone in the Hospital undergoing surgery.I will never forgive nor forget what Airtel did to me.

Let us all stop giving only our opinion and instead all get together, for "together we stand and all together we can command" Lets turn 'Airtel' into "teel a tale" Have you all herd this proverb " Airtel Akh thoo" This virus can destroy Airtel altogether.
