Indian restaurant sued for serving meat samosas to Hindu diners
Fremont: Moghul Express an Indian Restaurant in Edison, New Jersey can face lawsuits for unknowingly serving meat samosas to their Hindu diners on the eve of Indian Day celebration. As a result of consuming meat samosas, the Hindu customers say they have to travel all the way to India for the purification ritual in the India's Ganges River. A state appellate court ruled on Monday, July 18, 2011, to reinstate a lawsuit that was filed against Moghul Express, who confess they unintentionally served the Hindu customers meat samosas. The incident took place on 10 August 2009; when these customers had ordered for vegetarian samosas. They restaurant had assured them that they were not made with meat. But what they were served was a plate of meat samosas that was labeled vegetarian. The customers reported this when they realized the samosas they were consuming had meat stuffing. The restaurant though acknowledged their mistake; the outraged diners claim that this has harmed their religious sentiments. The Hindu customers subsequently filed a lawsuit in the Superior Court, which accused Moghul Express of their carelessness. The Superior Court judge dismissed the claims, which prompted the plaintiffs to appeal the judgment. The appellate court said the lawsuit could continue as a breach of express warranty, due to the restaurants assurance that they were being served vegetarian samosas.
