HC restrains firm from using Intel Corp's trade mark Intel

NEW DELHI: The Delhi High Court has restrained a firm involved in manufacturing paints and varnishes from using the brand name "Intel" to promote their products after computer major Intel Corporation asserted that it had exclusive right on the impugned trade mark. Holding that US multinational has prima facie made out a good case for grant of an ad interim ex-parte injunction, Justice CK Mahajan restrained Punjab-based DK Powders Inc from using the trade mark "Intel" in any form to sell their products. Intel's counsel Man Mohan Singh contended that the use of the mark "Intel" by Ludhiana firm for powder, paints and varnishes was illegal as it amounts to infringement of registered trade mark. The local firm adopted the popular brand to pass of its goods as that of Intel, he alleged. The American company submitted that it was astonished to see in the Trade Mark journal in June that the makers of paints and varnishes had applied for the registration of the mark "Intel". The counsel told the court that the trade mark "Intel" was coined by the computer major and it has invested huge amounts to make it popular. Accepting the arguments, the court said, "if the defendants (DK Powders Inc) are permitted to use the name 'Intel' as their trading style, Intel Corporation will suffer irreparable loss and injury which cannot be compensated in terms of money".
