"We are of the view that an employee who is in habit of remaining absent without prior sanction of leave, irrespective of the number of days, is guilty of misconduct under the rules," observed a division bench recently while upholding dismissal of a Bharat Sanchar Nigam (BSNL) employee, Pandurang Kevne, who filed a petition challenging his removal.
Justices J N Patel and R P Sondurbaldota further said, "In our opinion the reason for such misconduct is because it exhibits irresponsibility and lack of interest in work. It is writ large on the facts of the case that the petitioner is least interested in duty."
The Bench also referred to Rule 3 of Central Civil Services (Conduct) Rules, 1964, which states the requirement, that a government employee must during all time maintain absolute integrity and devotion to duty.
According to PTI, the petitioner was chargesheeted in 1997 for misconduct of absenteeism. An inquiry held him guilty and recommended his removal from service. On this, the employee filed an appeal before an appellate authority but it was dismissed. A reference was then made by the government to Industrial Tribunal which upheld the punishment.
The petitioner's Counsel B P Jakhade submitted that the entire period during which the petitioner was absent from service had been validly explained by him and his absence from duty was regularized by the respondent company by sanctioning different types of leave.
However, Counsel for BSNL, A S Rao, argued that even if the petitioner's leave was regularized, he cannot escape from the rigours of mischief of misconduct because the leave was not authorized.

my friends dont crib face life face the new change of life and the new age of work be it goct or private work is money and money is needed to live work but dont be slaves every employee should no his right at work place how many people know that if thing go wrong with u fight for it complain, in india in every city and state we have a asst.labour commisioner,labour commisioner,labour court,labour minister,ect complain if u have to face injustice i welcome the judgement of the court 1 should inform in writting for his leave and should go on leave with permission unless emergency respect work love ur work not ur company because the company will throw u one day but ur work will help u survive life and fill ur stomach .....jai hind

Most of the govt. offices leave applications are not sanctioned in a specific period. But prior information for availing any leave is must. This is totally depend on the superboss that how does he treat the leave matters vary employee to employee. Need to be in practical not in theoratical. In urgency the employee has to take leave giving only information, but after that the situation & relationship between employer & employee decide whether the leave applications are to be sanctioned or not.

Atleast the prior information is required if not taking sanction. Also agree the employees are required to take leave without taking proper sanctions or information due to some extreme exigencies which needs to be considered but yes to minimum extent and reasons thereto.

True but not the fact. It's one sided decision. In most of the coments, it has been already highlighted that the employess in private sector are treated as slave. There are organisations, wherein employee can't enjoy even their National holidays like Independence day & Republic day. We have lost our personal life. Even if, mother of an individual working in BPO is breathing in her last seconds of life, one is not allowed to take care of them. Employees working specially in BPO dont have any right to think of their Society & Nation. Indirectly, the western countries have made us Gulaam once again. We are not suppose to enjoy our own National holidays but of course we do enjoy US/AU/UK holidays.

I fully do agree with Mr.Sanjiv.The person working in a pvt.sector company is treated like a slave. I can give one example. I am working in a Indian managed Nigerian company and I am seating at their India office but I never enjoy our national Holidays even though now as X-mass and New year Nigerians are enjoying holidays I am not entitled to Holidays.Moreover those who r working in our sister concern are neither enjoy Indian National holidays nor even Nigerian holidays.They even don't have exact working hrs. , they even some times remain in duty for whole the day i.e' from 10-00Hrs. morning to next day night obviously in between they get the tiem for regular natural activities.

All of you who are replying or commenting on Sanjiv's mail, be honest and state if you were to become your own manager or the manager of the team, of which you are a part, would you have balls enough to stand up for the rights of your subordinates and grant them leave. I can bet my last paisa most of you would be more than happy to please your white skinned bosses in denying your team members or the subordinate even basic amenities.This is the sad truth of the the modern IT & ITES sector which is managed by those who live in the world of Excel sheets and are far removed from reality. they are not bothered about national pride or your mothers death if the Excel sheet figures reflect income from your skills.
The so called modern management concepts that these incompetent managers employ are but a big farce and no company whatever be it's reputation is exempt from the sin of exploiting and trouncing upon an individuals basic privileges so that a handful few can live in the lap of luxury.
Incidentally the Kevne case is known to me and this guy like many others in the Govt / public sector was busy with his own business while in service. He tried to twist and turn the law points to his favor but Mr AS Rao was a smart operator. Let it be known that he did not get this favorable order purely on merits of his argument. We all regularly read about the state of judiciary in the papers so I need not say much. Nevertheless I have no complaints on this order of the hon'ble HC

Especially in IT firms we need to bear a lot of stress.whatever your condition is you need to complete the work in given time and moreover if required you need to extend your working hours and work on weekends.please after all we are human beings not machines.

I agree that habitual absence without a prior permission should not be excused. But similarly there should also be rules that keep employee's interests in mind. I am not really sure as to what kind of pressure the employees of government organizations deal with. But in the private sector, there is a lot of harrassment towards the employees. We are made to stretch for hours together on a regular basis and we aren't getting paid extra for the extra time we put in. If we are helping the business generate its good will, it should also be equally concerned about its employees. I know of one such organization that ensures that an employee is at his seat for every minute of the required 8 hours that he spends at work. If there is some extra work, that employee is expected to stretch for a couple of hours and finish it without an incentive. But if he is even late by a minute he needs to be answerable to his manager. And most managers let their subordinate speak only after they have done their part of blasting him. It would be wonderful if the HC has something for people on the other side too.
I know its hoping against hope. I strongly feel that even justice is far from being just. Its surprising that the sculpture of the lady of justice holding the beam balance is hardly balanced. One side is always higher than the other. Probably that signifies that we need to read between the lines(conditions apply).

I Agree to the rule but wish some one can highlight if any such rule exists which warns the employer not to keep employee working after his working hours are and done there should be standard working hours.
Business minded people are losing there sense and making people strech for hour together after that regular shift or working hours. That's true that without permission one should not take leave, but what about grievances one has with other and due to which employee very upset to come office. There should be proper mechanism for grievance redressal and have to find out the actual reason for absenteeism.

Here it used to be you were allowed only 3 days absent from work per year and with a doctor's excuse or a good reason but you had to phone in in the morning first thing when the company opened to let them know you won't be there. Anything over 3 days first you'd get money taken from you for the work done that day and then a note to your file after a couple days missed. You'd lose your job if you continued your habit. So I agree with the judge.
In India though seems to me IT people might be on contract basis and not hourly. on contract usually means to work until the job is complete and as long as you get in the hours required (set by the employer) then shuffling your schedule around should be ok as long as the employer is informed ahead of time.

I agree with most of the comments, Usually IN Andhra pradesh specially in Govt departments I notice every govt official including some banks who work under govt name. The staff himself is a Govt. And they are authorised to Attendence register from their home. I dont think any one is their to question them or penalized for their Absents.I have my own company with a limited staff and most of the staff are sincer by any chance if they wann take leave the follow proper system of leave aplication etc. So why not Govt employees... End of the day the one who get salary for his work has to be sincre towards his faith as well. Because our Jobs are our GODS we cannot cheat our God....

In IT Companies, taking leave without prior permission is a very rare case.For genuine reasons where the employee is personally in critical situation, this is allowed. Whether it is a govt or a private company, definitely it is a must to inform the reporting authorities by mail or by phone prior to taking leave as the person's absense should not affect the regular planned work and there must be a substitution planned well in advance.This has got nothing to do with the relationship as informing prior is a courtesy. He has got a valid reason to argue if he is forbidden to take leave.If there is frequent absenteesm , it should be quantified and decided as per the rules and regulations of the companies or organisations. The employee also knows the rules about the attendance well , when he/she signs the appointment order. So i feel it will be appropriate if the decision to be left with the company/govt or private management to decide. The employee should abide by the rules of the private/govt management. Any proof of non genuine reasons and failing to abide the rules of orgnisations might be taken to the court of law as per the decision made by the management in private/govt orgnisations.

I think the statement "Employees can't take leave without permission" itself is not justified. It should be like "Employees can't take leave without prior notice". The approval of the leave applied depends on the boss and in case if the employee is in some emergency then he must not wait for the approval. Other then leaves , many other things are written in appointment letter. Does the companies abide to all this things. eg : Working hours are 9 hours but in IT most of the employee are working on an average 12 hours without getting anything in return for their sincerity and responsiveness.

Sure when it is privileged leave, but not in case of casual/sick leave. And any way this particular case must be applicable to Govt. employees and not private MNC etc. since they can sack employees on any other silly grounds too. And as such the employees not retaliate due to a common fear. We need to congragulate the judiciary system in our country, that, we have started realising that, it is we who need to demostrate our sincerity towards our work, rather than taking shelter of some old legal provisions, and escaping everytime a misconduct is noticed. A provision should be made wherein, the employee should be penalised and such amounts to be given to the company, for making the companies work suffer during such uninformed absence.
