Notice Issued To Stop Minors Accessing Facebook, Gmail Accounts


Bangalore: The Delhi High Court has issued a notice to the Central government, seeking on how minors under the age of 18 under Indian law could open an account in social networking sites and email accounts.

The petition was earlier filed by former BJP leader, KN Govindacharya, who had requested the government to recover taxes from social networking websites who are having their operations in India. Adhering to this plea, the court had issued notices to both Facebook Inc and Google.

The notice was sent after Govindacharya’s counsel Veerag Gupta argued that minors are getting into an agreement  with the social networking sites, which actually contradicts the Indian Majority Act, the Indian Contract Act and also the Information and Technology Act.

The petition filed, seeks the government to act on few aspects, such as, to ensure the safety of the data of 50 million Indian users, where the personal information of the user is being transferred outside the country.

The petition also directs the concerned authorities, to take corrective measures and undertake strict verification process to all existing users and future members of social networking websites.

However, Facebook on the other hand, has its own terms of service, it clearly states that anyone under the age of 13 cannot use the service and also specifies users to provide their correct personal information. Google too has drawn a line on age requirements; however, it does not specify any age restriction.
