CBDT To Clear Pending Appeals Worth 4K-Cr

BANGALORE: As the second quarter of financial year 2014-2015 started, Central Board of Direct Taxes (CBDT) has made up plans for clearing the pending appeals with the tax department. The target money is about 4000 crores. If the plan works out, undecided demands of more than 4000, crore will be cleared.

The objective of CBDT is to dispose 44 percent of appeals; about 95,560 cases that are pending with commissioners of income tax by the end of FY15. Out of the total cases, about 42,322 cases fall under high value appeals. The appeals have been sorted out in different baskets and the aim is to dispose all the high value cases. The disposal of high value cases includes the uncertain demand of more than 10 lakh and the total amount is likely to cross 4000 crore, if settled by March 2015.

If the commissioners of income tax work exclusively on transfer pricing cases, the need to clear a target of 150 cases per year. The number of cases of high value appeals pending in Mumbai are 8,684 whereas 5070 in Delhi. A well thought-out process has to be followed by the income-tax commissioner in case the taxpayers oppose the raised tax demand for them.

The first set of appeals has already reached the table of commissioner of income-tax.

CBDT’s other plans include strict actions against tax avoiders and monitoring of suspicious overseas transactions and NGOs. The CBDT's action plan in bold letters states: “All such cases must be processed for launching of prosecution at the earliest without waiting for any other proceeding,” reports times of India.

CBDT will inquire about the overseas transaction that will help in detecting the cases of tax avoidance as well as will support the facts with tax officials. Charitable organizations, non-profit companies and trusts will be examined carefully. Another set target is to improve the quality of investigation that will ensure success of tax officials.
