New Delhi : The Supreme Court had restrained the New Okhla Industrial Development Authority from issuing the completion certificates on Tuesday, by refusing to interfere with NGT; since, the value structure of the 'Okhla Bird Sanctuary' has been falling in within 10 km whereas all the flats buyers in several part of Noida have no alternative for a moment as a cost. Regarding the project of Sanctuary within 10km, the top justice Jagdish Singh Khehar and Justice C. Nagappan had turned down the request of Jaypee Infratech Ltd and accept the challenge of NGT by refused the certificate issue. In addition, the court also said; the application phase has not yet arrived as the government has yet move toward to conclusion on demarcating the restrictions areas of the eco-sensitive zone in the region of 'Okhla Bird Sanctuary' as directed by the NGT on April 3. The court had mocked the Uttar Pradesh Government by saying "One government says fragile area is 100 metres from the forest 'where the senior counsel of the court Abhishek Manu Singhvi said that nearly 4,000 flats are finished and flat owners who have paid for them are awaiting occupation certificates. If a limit barring creation activities has been laid down and if constructed structures are within it, then those have to be pulled down. He again stated the fact that, In 2006; the NGT says the apex court, that no construction activity would take place with 10 km radius of the bird sanctuary and if it were to be taken then it would take into its ambit India Gate, Parliament House, and Connaught Place, among others Where on the other side, Jaypee Infratech Ltd said 'if the NGT order was not stayed and buyers were not allowed to take possession of their flats then people will suffer in economy as well as in children's education' therefore, the idea of living next to sanctuary will be a serious crisis because of dealing with any non-compliance of ecological norms that may surface later. Towards the end, the court said; the matter will be unmoved until and unless the ministry of environment and forests (MoEF) seeks out the views of Uttar Pradesh, Delhi and Haryana and obtain a new judgment where as NGT asked the three state governments to respond to queries of the MoEF about demarcation of boundaries of the eco-sensitive zone. Afterward, the MOEF was asked to hold a meeting to decide the issue and also said that 'any decision by the MoEF would be subject to the final outcome of the matter' which are already pending before the apex court.
